Valuation of a shareholding
In the context of an international arbitration dealing with an alleged inaccurate and unfair valuation of a participation, a multinational group operating in the energy industry required the assistance of VVA Expert Opinion as advisor.
The object of the dispute was an alleged inaccurate and unfair appraisal, performed by an independent party, of the value of a participation transferred by the defendant to the plaintiff. The technical assistance had to ascertain whether and to what extent the estimation of the value included errors “beyond any reasonable doubt”.
Contrary to the conclusions contained in the final report of the advisor appointed by the arbitrators, the board of arbitrators rejected the thesis of the plaintiff and imposed the payment of the whole value formerly appraised by the independent evaluators in favour of the defendant.
