Valuation of Damage
A multinational group operating in the industrial goods industry required VVA Expert Opinion to provide the quantification of the economic damage due to a patent infringement perpetrated by the main competitor.
Through the application of the infringer’s profits approach, the economic sufferings of the legal owner of the patent have been appraised. In light of the economic circumstances surrounding the infringement, it has been also proved that the economic damage should fall above the normal range of market values if one considers the relevant competitive advantage that the legal owner would have achieved through the exclusive exploitation of an innovative patent in the context of a duopoly.
Upon completion of the hearings, the vast majority of the claimant arguments and determinations have been accepted in the final report of the court-appointed expert.
